TERMS OF SERVICE
FOR ART COMMISSIONS

The terms and conditions listed below are a general guideline and are subject to change at my discretion. These terms can be discussed and changed before payment if you have any issues (Ex. You don’t want me posting the artwork in my online portfolio). If we have previously altered or changed any of the terms listed below that does not guarantee those changes will remain in effect if you commission me again in the future, the terms as listed below apply to each new order unless stated otherwise.

GENERAL TERMS

  • ​All completed illustrations will include a signature that may not be removed, cropped or altered in any way.
     

  • Personal commission prices are subject to change at my discretion.
     

  • I have the right to reject or terminate an order if I feel uncomfortable with the request for any reason.

02.

PAYMENT

  • Currently, all currencies are accepted, however, please be mindful that any listed prices or invoices are in CAD.
     

  • Payments can be processed through PayPal, Square, or through a direct invoice emailed directly to you. Alternate payment methods such as bank or eTransfer can be discussed.
     

  • Payment is taken either 50% of the total cost before starting work and 50% after final sketch approval, or 100% of the total cost before starting work. A minimum of a 50% deposit must be paid before I will begin work on your commission.
     

  • Failure to pay within 30 days of being invoiced will result in a cancellation of your commissioned work.
     

  • Sending payment before I’ve agreed to take your commission and sent you an invoice does not guarantee I will do any work for you.

03.

PROCESS
& DELIVERY

  • You will be notified when I start to work on your commission. Once you have been notified if for any reason you wish to cancel your order you will only be eligible for a partial refund (See Cancellations and Refunds).
     

  • Sketches and works-in-progress will generally include watermarks that will not be a part of the final image.
     

  • I will not proceed to finalize your commission until you’ve reviewed the sketches you were provided and approved any changes in writing.
     

  • It takes time to complete a commission, 2 weeks – 3 months depending on the complexity of the order, workload, and other external factors.
     

  • If there are any delays with the initial time estimation to complete your commission you will be notified as soon as I am able.
     

  • You will receive a full-resolution file of the finished artwork, along with a web-friendly version, in the format of a JPG or PNG unless otherwise specified. There is no physical product, however, if you wish we can arrange for your commission to be printed.

04.

REVISIONS

  • The number of revisions included in the price of the commissioned piece varies depending on the complexity. Please see Art Commission Info for details.
     

  • If you would like something changed in the final piece there will be an extra charge for those changes — unless there has been a misunderstanding on my part.
     

  • If you would like me to change something you previously approved there will be an extra charge. The extra fee will be dependent on the complexity of the change and will be based on a living hourly wage.

05.

COPYRIGHT
& USAGE

  • I, Ashe Lynn (the artist):

    • Retain all copyrights over the commissioned artwork.
       

    • Do NOT claim the intellectual property of any characters that are not my own.
       

    • Will not profit further from the commissioned artwork unless you, the buyer, break any of these terms.
       

    • Reserve the right to post the commissioned artwork online and in my portfolio (this condition can be discussed should a commissioner desire the artwork to remain private).
       

  • You, the buyer:

    • May upload the commissioned artwork on any website or social media.
       

    • May NOT make profits from the commissioned artwork (such as reselling, uploading to print-on-demand services, making prints, etc).
       

    • Retain all rights to the intellectual property of any original characters.
       

    • May NOT use the commissioned artwork for commercial purposes. If you wish to do this the rights for commercial use can be purchased at any point — contact me for more information.
       

  • The following is considered copyright infringement:

    • Reproducing/using the artwork commercially — this means making money off of my artwork in any way.
       

    • Claiming the artwork as your own.
       

    • Removing my signature and/or altering the artwork in any way without my consent.

06.

CANCELLATIONS

& REFUNDS

  • Once I have notified you and started work on a commission you will only be entitled to a partial refund. I will retain 25% of the total cost of the order as a non-refundable deposit and you will be refunded the remainder of what you paid.
     

  • If for any reason I am unable to start your order after you have paid the deposit you will be given a full refund.
     

  • If you cancel your order before I am able to start working on it you will be given a full refund.
     

  • If you are getting a refund please DO NOT request a PayPal chargeback, I will refund you the money myself as soon as I am able.
     

  • If at any point you request a PayPal chargeback when you were not eligible for a refund you forfeit all rights to any artworks complete or incomplete. I will decline the chargeback and provide PayPal with evidence of our communication as proof of services exchanged. In addition, you will be blacklisted from ordering a commission from me again.

Cancellations & Refunds

WHAT DO YOU GET?

  • Thumbnails/mockups you must review and decide which to continue with. Depending on the complexity of the commission there may be more or fewer thumbnails.
     

  • A final sketch and/or sketches of the full artwork reflecting choices made by you, the commissioner, that you must accept before I continue the work. Works-in-progress may include colour tests/samples.
     

  • Involvement in the decision-making on everything from composition, colour, and background elements (Depending on the complexity/specifications of the commissioner).
     

  • A full-resolution file* of the finished artwork and a smaller web-friendly file for posting online. Final file formats are JPG or PNG.

    epending on the type and intent of the commission sizing will vary. The average print size is 8.5 x 11" or 11 x 17" at 300 DPI)
